1.0 Privacy Policy

1.1 This policy covers how we use your personal information. We take your privacy seriously and will take all measures to protect your personal information. Any personal information received will only be used to fill your order. We will not sell or redistribute your information and personal data to anyone. We respect and protect your privacy.

2.0 Money back guarantee & refund policy

2.1 Refunds: If a client has retained the services for one year and has pre-paid IT Nut Hosting for such services, refunds will be issued for any unused full month of the services, upon client’s request. Therefore, if client’s account is canceled at any point during the one-year term, the client will be entitled to a refund for the months remaining, after notice given by the 25th day of the preceding month.

2.2 For shared hosting, WordPress hosting and reseller hosting we provide 30 days of money-back guarantee. And 15 days money-back guarantee for VPS service. If you feel that our product or service has not enough value as we promised on our website, we will issue you a full or partial refund (depending on the case). But you have to show proper evidence to prove your complaint. And you must request the refund within the guarantee period. No refund will be issued after the guarantee period expires. No dedicated server, SSL, domain, third-party services and add one product cover the money-back guarantee policy even if you only used it for 1 hour or you never used it.

2.3 There are absolutely no refunds for the dedicated server, SSL, domain and add one product(s) – even if the service has only been used for an hour or never used after ordering, we will not be able to issue a refund.

2.4 Custom software installations fees, setup fees, migration fees (if applicable) and fees for paid control panels and software licenses are not refundable.

2.5 You will not receive any refund for any kind of abused termination or abused suspension.

3.0 Hacking / DDoS / Interference

3.1 We monitor the traffic flow on our network. If our systems detect suspicious traffic, we will review it manually. We do not allow DDoS, hacking or any other interference to our or remote systems to be caused as a result of your actions. Any such event will result in immediate suspension of the service.

4.0 Account Suspension / Termination

4.1 Any DMCA content, hacking, copyrighted content, adult content and warez, email marketing from shared/reseller hosting account is not allowed. Any kind of suspicious activity can cause account suspension without any notice.

4.2 Any kind of payment due for 7 days will cause account suspension. Any account suspended will be reactivated upon paying the due bills within 30 days of suspension.

4.3 If you don’t pay your bills within 30 days of suspension your account will be terminated permanently. We don’t supply any backup for free after 30 days of your account termination. But you still for a full backup of your account from us this will apply $50 backup restoration charge. But if you have CloudBackup service added with your hosting you can restore your terminated account for free within 90 days. If you don’t have the CloudBackup serviced added with your hosting and still, you want to avoid the restoration charge then you have to purchase CloudBackup service for 12 months.

5.0 Shared Hosting Accounts

5.1 We only allow 200,000 inodes per cPanel account, because that is where we see optimal server performance. We do understand that not all of our customers can reduce their file count that far; for this reason, this is a “Soft limit” meaning that while the limit is reached, you will still be able to upload files. Once the account exceeds 200,000 files then it will be in violation of our Terms of Service and can result in possible suspension. If you need to increased inode open support ticket and increased inodes 100,000 it’s the only cost is 5$ per month.

6.0 Server Uptime Guarantee

6.1 IT Nut Hosting guarantees 99% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. Should we fail to deliver this for any given calendar month, your account will be refunded a pro-rated amount for the duration of excessive downtime.

6.0 General Data Protection Regulation (GDPR)

6.1 Storage of Personal Data

The data that we collect from you is stored in the USA, but it may be processed by staff operating outside the US and EEA (European Economic Area) who work for us or one of our affiliates. Such staff may process your data while fulfilling orders and providing support for your services. By using our services, you acknowledge that your data may be processed outside of the EEA.

6.2 Protection of Personal Data

IT Nut Hosting employs a variety of security measures to protect personal data from unauthorized access. However, no part of the Internet can be considered 100% secure.

6.3 Data Retention

Your data will be retained and processed as long as it is required to comply with applicable legal, tax, or accounting requirements.
At the end of the retention period, we will either delete or anonymize your data, unless it is stored in a backup archive and isolated from further processing.

6.4 Updating, Deleting and Downloading Your Data

You may update your data at any time either through the client area Account section or by submitting a support ticket. We may require proof of identification in order to change certain data fields.

You may request that Greenviewsoft export your personal data by opening a support ticket.

Customers with no active services may request that their account be closed and personal data be deleted from Greenviewsoft’s databases, with the exception of: billing system access logs, which may be stored for any duration of time at Greenviewsoft’s discretion, cases where financially fraudulent or otherwise illegal activity is deemed to have occurred (as determined by Greenviewsoft management or law enforcement officials), in which case personal information may be retained indefinitely for purposes of ongoing investigation and prevention of fraud recurrence, or cases where a violation of the Terms of Service has resulted in termination of Customer’s account, in which case personal information may be retained indefinitely for purposes of prevention of further use of Greenviewsoft’s services in the future by the offending Customer.

IT Nut Hosting will not delete any data required to comply with our legal obligations and financial requirements, or any data required to resolve disputes and enforce our legal agreements and policies.

6.5 Communication

We may contact you directly or through a third-party service provider regarding products or services you have ordered from us. We may also send you marketing emails if you have opted-in through the client area. Communication methods may include: email, text (SMS) message, IRC chat, push notifications, or automated phone calls. IT Nut Hosting does not offer phone support and will not call you directly at any time.

6.6 Use of Non-Personally Identifiable Information

We may share aggregate statistical data about our customers with third parties, such as advertisers or suppliers. This aggregate statistical data will not identify you personally.

6.7 Your Rights Under GDPR

If you are a resident of the EEA, you have the following data protection rights, which you may exercise by contacting us via support ticket:

Right to Access – You have the right to access your personal data and to request a data export from us.
Right to Rectification – You have the right to have any incorrect or incomplete personal data corrected.
Right to Restrict – You have the right to request the restriction of processing your personal data where there is no legitimate reason for us to do so.
Right to Object – You have the right to object to the processing of your personal data where we have no legitimate reason to do so.
Right to Erasure – You have the right to request the erasure of any personal data we have collected. However, this right does not override our financial and legal requirements to keep certain data (see above).
Right to Withdraw Consent – You have the right to withdraw consent (unsubscribe) from any marketing communications we may send you.
Please note that we may ask you to verify your identity before responding to such requests.

You have the right to complain to a Data Protection Authority about our collection and use of your Personal Data. For more information, please contact your local data protection authority in the EEA.

6.8 GDPR Data Processing Agreement

You do not need to sign the DPA. By agreeing to our Terms of Service and using our products and services, you are automatically accepting our DPA. If you choose to sign it, you may send a copy to [email protected]

6.9 Age Restrictions

Our service is not available to children under the age of 18, and we will not intentionally maintain personal information about anyone under the age of 18.

7.0 Offer Abuse

We run promotional offers occasionally for our new customers. If you are one of our existing customers and try to cancel your previous package to get the new offer we will not allow that. Please understand that a company needs to make revenue to sustain. If we can provide you value you should not manipulate offers just to get discounts regularly. We can not continue to provide you enough value and good support just like we are doing now. So, please do not try to manipulate our offers. If you do so, our automated AI (Artificial Intelligence) will mark it as an “Offer Abuse” and instantly cancel your order. And we don’t provide any refund for abused termination. Thank you for understanding.

8.0 Suspension & Termination Rules

8.1 Web Hosting Service Suspension and Termination

Suspension generally happens automatically when you have a due bill. If you don’t pay your bill within the due date your account will be suspended on the same day. After the suspension, we allow you 27 days to make the payment and unsuspend the service instantly. But if your invoice still remains unpaid, our system terminates your account permanently with all the data it contains. Once an account has been terminated, it can not be reactivated by paying the unpaid invoice(s). But if anyone wants to restore the terminated account with the data they can do it within 90 days by paying $50 restoration fees.

8.1.1 Hosting Abuse Suspension

The following actions will result in abuse immediate suspension of your account:

  1. Bulk email sending from the website, webmail or using any script.
  2. If we receive any email spamming report we will suspend your account.
  3. Excessive server resources will result in account suspension until you upgrade your package. (You will receive notice before the suspension.)
  4. Any kind of activity on your website that is prohibited by international law and your local ICT act will result in immediate account suspension. (It may also result in permanent termination.)
  5. File usage policy violation will result in suspension.

8.1.2 Hosting Abuse Termination

The following actions will result in abuse termination of your service or account:

  1. Hosting any phishing link/script/content
  2. Any kind of activity on your website that is prohibited by international law and your local ICT act might result in account termination. (It may also result in a temporary suspension, for investigation accuracy.)
  3. If you try to spread hates or conflicts between any nation, religion, society, community using our service.
  4. Any kind of payment or card fraud will result in immediate service termination.
  5. We don’t allow any scamming and spamming using our service.
  6. We strictly maintain anti-govt activities, cryptocurrency (for the restricted countries such as Bangladesh), any kind of money laundering activities, make money or invest scam. If you do anything like this your account will be permanently terminated without any prior notification.
  7. It’s up to us to provide you data backup, In case of any kind of abuse termination and abuse suspension. And by accepting these terms, you agree that you will not even ask for data backup if you violate the termination rules.

9. Cancellation Policy

9.1 Hosting Cancellation: You can cancel your hosting services anytime by submitting a cancellation request from our client area. no cancellation fees will be applicable for the normal cancellation process. If you want to get the money back after cancellation, you have to create a support ticket at the billing department for processing the money back. After that our billing operator will review if your service cancellation is eligible for a refund according to our money-back guarantee and refund terms. If it is eligible, we will refund you the money. If it is not eligible we will deny the refund request.

9.2 Domain Cancellation: You can not change your domain once it has been registered. But you can cancel your domain within 72 hours of its registration. But there are $3 domain cancellation fees. If your domain’s price is more than $3 then, we will issue a refund for the remaining amount.
